Supreme Court Alcohol Shipping Case Cert Denied in Block v. Canepa
Ohio asked the Supreme Court to take up its fight over interstate wine shipping. Today, the Court answered: “Petition DENIED.”
The Sixth Circuit had directed the district court to “declare both Restrictions unconstitutional”—Ohio’s restriction on direct wine shipments from out-of-state retailers and its six-bottle limit on wine consumers personally bring into Ohio.
The denial leaves that ruling in place. It supplies no nationwide answer to the retailer-shipping dispute, but it leaves Ohio facing the consequences of its loss. For retailers, wholesalers, and suppliers following the boundaries of the three-tier system, that deserves attention.
